Introduction & Acceptance of Terms:
Welcome to T- Minds psychiatric care and mental health counselling centre. This website is owned and operated by T-Minds mental health clinic, a healthcare entity incorporated and governed under applicable Indian laws with its registered business place at Kurnool, Andhra Pradesh. The terms and conditions explain how you may access, use our services- whether in person at our clinic or online through our website, Tele-consultation platforms (app) and digital systems. By accessing, booking, or using any service (online or in-person), you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of this agreement, you must discontinue the use of our services immediately.
Before beginning it is important to be aware of the structure of consultation,, counselling process and your associated rights and commitments. This consent form (attachment) aims to ensure full transparency and provide necessary information before you engage in therapeutic services.
Disclaimer:
T-Minds mental health clinic is not equipped to handle medical or psychological emergencies and cannot provide crisis intervention of any kind. Our services are intended solely for non-emergency mental health support. This platform is not and should not be used as a replacement for emergency medical, psychiatric, crisis-response services.
If you or someone you know are experiencing any of the following conditions- including but not limited to thoughts of self harm, suicidal ideations, urges to harm others, severe emotional distress, or symptoms of acute psychiatric conditions such as psychosis, schizophrenia and any other medical emergency, or if you feel you are in danger you are suggested to immediately contact nearest hospital or avail local emergency services, notify appropriate police or emergency medical authorities without delay.
By choosing to use T-Minds you acknowledge these service limitations and agree to seek prompt, in-person emergency care whenever necessary, understanding that online platforms cannot replace or delay urgent medical or psychiatric assistance.
T minds may reserve the right to modify, update, and amend these terms and conditions at any time in whole or in part at its sole discretion. Any such changes shall take effect immediately once the updated terms are made available at our official website. It is your responsibility to review the terms periodically. Your continued access or use of our services after the publication of revised terms shall constitute your acceptance of the updated terms. The terms and conditions supersede any prior agreement, understanding, representations, or communication (oral or written) relation to your use of t minds services.
Definitions:
“T-Minds”, “T-Minds mental health”, “Company”, “Firm”, “Platform”, “centre”, ”Service provider”, “We”, “Our”, “Us” or other similar terminology are all in reference to _______.
“user”, “client”, “you”, refers to any individual who accesses, registers for, books, or uses any service offered by T-Minds, whether through website, mobile platform, app, or through any other digital medium, or seeks information from the resources provided in the website. it also includes individuals who seeks metal health support for themselves, for others and for minors for whom they are legally responsible.
“Psychiatrist”, “clinician” refers to licensed medical practitioner specialized in psychiatry(MBBS, MD psychiatry) registered with a recognized medical council of India, who is qualified to diagnose, prescribe medications, and provide psychiatric treatments as per applicable laws and medical regulations.
“Psychological wellness professional” refers to any trained and qualified mental health provider including clinical psychologist, counselling psychologist, psychotherapists, mental health counsellors, behavioural health specialists who provide mental health support.
‘Consultant” refers to psychiatrist, psychologist, practitioner, counselling psychologist, mental health professional, programme coordinator, life coach mental health expert, mental health advisor or any other individual who have been authorised by T Minds to use the platform for providing services.
“Services” refers to all mental health-related support offered by T-Minds, including but not limited to psychiatry consultation, follow-up appointments, assessments, wellbeing programmes, digital communication, informational content, and any other resources provided through the clinic, website, digital platforms. Services do not include crisis intervention, emergency medical or psychiatric treatment.
“Telehealth/Online Consultation” means any session conducted through video, audio, text or digital communication platforms.
“Third party services” refers to any products, applications, software, tools, payment gateways, communication systems, diagnostic platforms, or services that are owned, operated, or provided by entities other than T-Minds. This includes external website, telecommunication providers, video-consultation platforms, payment processors, scheduling tools, cloud services, or any third party integrations used to facilitate or support the delivery of services.
Session” refers to any scheduled appointment, consultation, counselling interaction, psychotherapy meeting, psychiatric evaluation, follow-up, or wellbeing engagement programme conducted by T-Minds. A Session may be delivered in person, via telephone, or through online/tele-consultation platforms supported by the T-Minds.
Nature of Services:
T Minds provide clinical consultative, diagnostic, therapeutic, supportive services through qualified health care professionals, both in person and through digital/online modes. T minds offer following services:
- Online/offline psychiatry consultation with expert psychiatrists authorised by t minds to use the platform for delivering services.
- Online/offline consultation with expert psychological wellness professionals authorised by t minds to use the platform for delivering services.
- Individual, couple, family, group counselling sessions.
- Parental counselling and psycho education.
- Pre and post marital counselling, sexual health counselling.
- Workplace mental health counselling, Employee stress counselling, occupational stress counselling.
- Periodical psychological assessments/ tests conducted by qualified and trained mental health professionals.
- Online self assessments.
- Webinars/workshops conducted by mental health professionals/psychological wellness professionals
User Agreement, Code of conduct and permitted use:
- By accessing T-Minds services, you affirm and agree that you are competent to enter into a contract under Indian law. You further affirm that you are 18 years of age or older. Users below 18 years (minors) may access our services only with the consent, supervision and active involvement of a parent or legal guardian, in accordance with the Indian Contract Act, 1872, the Telemedicine Practice Guidelines, 2020, and the Tele-Psychiatry Operational Guidelines, 2020.
- If you are accessing services for yourself or on behalf of another person whom you are legally authorised to represent, you agree not to misstate your identity, impersonate any other individual or entity, or provide misleading information.
- All information you provide to T-Minds must be accurate, complete and truthful. If the information provided appears false, incomplete or reasonably suspected to be so, T-Minds reserves the right to suspend or terminate access without prior notice.
- T-Minds may take reasonable steps to verify certain details; however, we do not assume responsibility for verifying age, guardianship, legal authority, or the authenticity of documents or information submitted. If we become aware of any violation or misrepresentation, we may take appropriate corrective action, including suspension of access, until compliance is ensured.
- You agree to use the platform and services strictly for lawful, personal and non-commercial purposes, and in accordance with these terms.
- You agree to provide accurate and updated information regarding your mental health, physical health, symptoms, medications, and past treatment history. Failure to disclose relevant information may impact the quality, safety, and effectiveness of care.
- You are responsible for maintaining the confidentiality of your login credentials and preventing unauthorised access to your account.
- You will ensure that tele-consultation takes place in a private, safe, and distraction-free environment where confidentiality can be maintained. You are responsible for having a functioning device, a stable internet connection, and updated software necessary for virtual consultations.
- You agree to pay all applicable fees for services you use, including cancellations and no-show charges as per T-Minds cancellation and refund policy.
- You agree not to allow others to access services on your behalf unless you are legally authorised to do so and have disclosed such authorisation to T-Minds.
- You agree to cooperate if, in the clinician’s professional judgment, guardian involvement, in-person consultation, or emergency referral is required for your safety.
- You must promptly update any change in personal details, contact information, or emergency contact to ensure uninterrupted and safe delivery of services.
- You shall at all times remain compliant with all applicable laws of India, including statutory provisions, regulatory requirements, healthcare and tele-consultation rules, data-protection obligations, and electronic-usage norms.
E-prescription:
- T-Minds may provide electronic prescriptions (“e-prescriptions”) as part of tele-consultation services, strictly in accordance with applicable Indian laws and guidelines. E-prescriptions shall only be issued after the clinician has completed an adequate assessment based on the information and symptoms you provide during the session. The clinician retains full professional discretion to decide whether a prescription is necessary, appropriate, or clinically safe.
- You understand and agree that certain medications, including all Schedule X drugs, psychotropic substances regulated under the NDPS Act, benzodiazepines, barbiturates, sedatives, and any medication classified by law as “prohibited for telemedicine”, cannot and will not be prescribed through tele-consultation. You agree not to request such medications, misuse prescriptions, or attempt to procure restricted substances through inaccurate disclosure.
- You agree to provide complete, truthful and updated medical information, including past and current medications, allergies, adverse reactions, substance use history and physical or mental health conditions that may influence prescription safety. Failure to disclose relevant information may result in inappropriate or unsafe treatment, for which T-Minds shall not be liable.
- You understand that the clinician may modify, refuse, discontinue or limit prescribing based on safety, incomplete disclosure, risk assessment, need for physical examination, regulatory restrictions, or concerns regarding misuse or diversion of medication.
- You are responsible for using the e-prescription only for lawful purposes, presenting it only to licensed pharmacies, and complying with the dosage, duration and instructions given by the clinician. Alteration, tampering, forging, copying, reusing or redistributing prescriptions is strictly prohibited and may result in termination of services, reporting to authorities, or legal action as required by law.
- You understand that the validity period of e-prescriptions shall be as per applicable pharmacy regulations, and T-Minds does not control pharmacy policies, stock availability, fulfilment timelines or dispensing decisions made by independent pharmacists. Pharmacies may refuse to dispense medication if they suspect risk, non-compliance, governing restrictions or prescription misuse.
- You acknowledge that medication effects vary by individual, and those delays, adverse reactions or lack of improvement must be reported to the clinician promptly. Emergency reactions require immediate in-person medical attention.
- Clinicians may require in-person evaluation, diagnostic testing, biometric verification, or follow-up consultations before issuing or renewing prescriptions, especially for psychiatric medications or where safety monitoring is essential.
- E-prescriptions are issued solely for your personal therapeutic use and may not be shared, transferred, or used by any other person. If you are accessing services on behalf of another authorised beneficiary, you must ensure that the prescription is used exclusively for that individual.
- T-Minds do not guarantee issuance of an e-prescription in every consultation. The clinician’s professional judgment governs whether medication is clinically indicated. Fees paid for tele-consultation are for the consultation itself and are not dependent on whether a prescription is issued.
- You understand and consent that your prescription and related treatment information may be stored securely in electronic medical records as required by law, and may be accessed for follow-up care, audits, regulatory compliance or medico-legal documentation.
Prohibited use and restrictions:
Your use of this platform shall remain subject to certain following restrictions:
- You will not use the platform or services for any commercial, promotional, or revenue-generating activity, including selling, reselling, advertising, brokering, or facilitating appointments.
- You will not modify copy, reproduce, republish, upload, post, transmit, or distribute any content, material, session recordings, therapist notes, or proprietary information without prior written consent from T Minds.
- You will not record, store, or share any therapy session (audio, video, or chat) without explicit written consent from both T Minds and the clinician. Unauthorized recording is strictly prohibited.
- You will not use the platform for any unlawful, harmful, threatening, harassing, defamatory, or abusive purpose, or in a manner that violates any applicable law, including mental-health standards of care.
- You will not attempt to gain unauthorized access to the platform, accounts, data, or systems, whether through hacking, password mining, or any other illegitimate method.
- You will not engage in activities that disrupt, damage, or interfere with the functionality or security of the platform, including introducing viruses, malware, or harmful code.
- You will not extract, scrape, mine, or harvest data, content, therapist information, or client information from the platform, whether manually or through automated tools.
- You will not use the platform to seek medical emergencies, crisis intervention, or urgent psychiatric care, as the services are intended solely for non-emergency mental-health support.
- You will not use any platform content to train AI systems, machine-learning models, datasets, or research applications without written approval from T Minds.
- You will not upload or transmit any content that violates privacy rights, including sharing another person’s confidential or personal information.
- You will not use the platform for any obscene, immoral, misleading, fraudulent, or unethical purpose.
- You will not submit false, misleading, inaccurate, or impersonated information while creating or using your account.
- You will not engage in spam, phishing, pharming, pretexting, spidering, crawling, scraping, or any similar activity.
- You will not infringe upon or violate any intellectual property rights of T Minds or of any third party.
- You will not harass, insult, harm, abuse, defame, slander, disparage, intimidate, or discriminate against any individual or group based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
- You will not interfere with, disable, bypass, or attempt to circumvent any security features, access controls, or integrity safeguards of the platform.
- You will not use or attempt to use the platform in violation of the Telemedicine Practice Guidelines (2020) or the Tele-Psychiatry Operational Guidelines (2020) issued under Indian law.
- You will not use the platform if you belong to or reside in a jurisdiction where the use of this platform or receipt of services provided by T Minds is prohibited under applicable laws.
Appointment Booking & Scheduling:
- Clients may book appointments through our website, mobile app, telephone.
- Before the commencement of any consultation, therapeutic session, or psychological assessment you or your legal guardian (where applicable) will be required to provide informed consent either digitally or through a signed physical document. As a part of providing services we may collect your personal details, medical history, and your acknowledgement of our clinical policies. By providing such consent you expressly agree to receive services and also understood and accepted all applicable policies and terms. If you refuse to sign or agree to the terms and policies we may not be able to provide services.
- For clients under 18 parents are must attend the session along with the client.
- By enrolling in any group therapy sessions, support group workshops, psycho educational programmes, webinars offered by t minds you acknowledge that such programmes operate under additional guidelines which may be communicated in writing or verbally at the commencement of the program. All participants are required to strictly maintain the confidentiality of information shared by other members.
- All appointments are subjected to availability of and shall be confirmed only upon receipt of a booking confirmation from our system or clinic.
- We reserve the right to reschedule, postpone or cancel the appointments due to professional or operational reasons. In such cases reasonable measures will be made to inform the clients in advance.
- Clients are responsible for providing accurate contact information to receive appointment related notifications.
- Delayed arrival may result in reduced consultation time, or where necessary rescheduling of the appointment.
- Repeated no-shows or last minute cancellation may lead to restriction or denial of further appointments.
- This platform does not undertake responsibility for emergency or crisis-care services. We do not assess, manage, or respond to situations involving imminent risk medical and psychiatric emergencies, suicidal ideation/intent, self harm, violence, or any condition requiring urgent intervention. Client acknowledges that in such circumstances they must seek immediate assistance from emergency medical services or government approved help lines ( Telemanas etc).
- Services provided at the discretion of website.
Fees, Payments & Refund Policy:
By accessing the platform user agrees to pay the entire applicable session fee, assessment charges and programmes fees in advance at the time of booking services unless otherwise specified. Booking will be confirmed only after successful payment. You agree to provide accurate billing information and authorise us to process payments through our approved payment partners.
For all the information related to fee, charges, payments methods the user shall refer to payment section of the cancellation and refund policy.
All the cancellations, rescheduling requests and refund claims shall be strictly governed in accordance with our cancellation and refund policies. No exceptions shall be made outside the scope of that policy. T minds reserves the right to modify, amend or replace any or all parts of the cancellation and refund policies at its sole discretion without prior notice or liability to the user or any third party. Continues use of our services after such changes shall constitute deemed acceptance of the updated policy.
Confidentiality & Privacy:
T minds provide services over the internet. Use of our website, mobile application, online platform, digital resources is governed by t minds privacy policy. By accessing or using our services you acknowledge that you have read understood and agreed to the privacy policy.
T minds reserves the right to amend, modify or delete any or all parts of the privacy policy at its sole discretion, without prior notice or liability to the user or any third parties. Continued use of the services after such changes shall constitute deemed acceptance of the updated privacy policy.
Limitation of Liability:
- T Minds functions solely as a technology and facilitation platform that enables Users to connect with independent Mental Health Professionals. T Minds does not provide therapy, counselling, diagnosis, medical treatment, or any form of clinical service. All therapeutic or clinical decisions, advice, recommendations, or interventions are the exclusive responsibility of the Mental Health Professionals.
- Mental Health Professionals listed on the Platform are independent practitioners. No agency, employment, partnership, supervisory control, or professional responsibility relationship is created between T Minds and any Mental Health Professional. T Minds shall not be liable for any acts, omissions, advice, treatment outcomes, or representations made by any independent Mental Health Professional.
- T Minds cannot guarantee neither that a User will be accepted by any particular Mental Health Professional, nor that the same professional will be available or continue throughout the course of therapy. The decision to accept a User, continue treatment, or modify the treatment approach rests solely with the Mental Health Professional.
- Therapy outcomes vary across individuals. T Minds does not promise, warrant, or guarantee any specific emotional, behavioural, therapeutic, or medical result from counselling or therapy sessions facilitated through the Platform.
- During therapy, the Mental Health Professional may determine that online therapy is not suitable, or that additional referrals or changes in the treatment plan are required. These decisions fall within the scope of professional judgement, and T Minds shall not be held responsible for such determinations or their consequences.
- T Minds undertakes reasonable steps to verify the credentials of Mental Health Professionals; however, the accuracy, completeness, and authenticity of information provided by Mental Health Professionals are their own responsibility. T Minds shall not be liable for any misrepresentation, fraudulent credential, or false professional information supplied by Mental Health Professionals.
- Information, content, tools, and resources on the Platform are made available solely for general awareness and educational purposes. Such content must not be considered a substitute for professional medical or psychological advice. Users remain responsible for any actions or decisions taken based on therapeutic recommendations, platform materials, or professional guidance. T Minds shall not be liable for any distress, harm, or adverse consequences arising from the User’s implementation of therapeutic activities or exercises outside of sessions.
- The Platform is provided on an “as is” and “as available” basis. T Minds does not guarantee uninterrupted, timely, secure, or error-free service. T Minds shall not be liable for technical failures, downtime, server errors, connectivity issues, software bugs, or any system malfunction beyond reasonable control, including but not limited to cyber attacks, hacking, or data breaches affecting Platform performance.
- The Platform relies on third-party service providers (such as hosting services, communication tools, and payment gateways) for certain functionalities. T Minds does not assume liability for failures, delays, errors, or acts of omission by such third-party providers, including payment gateway issues, communication failures, or data incidents beyond T Minds’ reasonable control.
- Any data, content, or files downloaded through the Platform are accessed at the User’s own risk. T Minds shall not be liable for any device damage, data loss, or unforeseen issues arising from such downloads.
- Mental Health Professionals may be legally required to disclose certain information under the Mental Healthcare Act, 2017 or other applicable laws if there is imminent risk of self-harm, harm to others, or when disclosure is mandated by a court or law enforcement authority. Such disclosures, when made in good faith, do not create liability for T Minds.
- T Minds shall not be responsible for any loss, harm, or consequences arising from misuse of the Platform, non-compliance with these Terms, or breaches of confidentiality caused by the User’s own actions (for example, using shared devices, insecure networks, or recording sessions without consent).
- T Minds operates in accordance with Indian law, and shall not be liable for non-compliance with regulations or legal requirements of jurisdictions outside India.
- To the fullest extent permitted by law, T Minds and its officers, employees, agents, contractors, affiliates, licensors, and Mental Health Professionals shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including emotional distress, loss of data, loss of profits, loss of goodwill, reputational damage, or damages arising from third-party conduct or technical failures. This applies even if T Minds has been informed of the possibility of such damages.
- Nothing in this clause excludes liability for death or personal injury caused by proven negligence of T Minds, fraud or fraudulent misrepresentation by T Minds, or any liability that cannot legally be excluded under applicable Indian law.
- If any liability is established despite these limitations, the maximum aggregate amount that T Minds may be held liable for shall not exceed the total fees paid by the User to T Minds for Services in the three (3) months preceding the incident giving rise to the claim. If no fees were paid, liability shall be limited to the minimum amount permitted under applicable law.
- Any claim arising out of the use of the Platform or Services must be raised within three (3) months from the date of the event or occurrence leading to the claim; otherwise, such claims shall be permanently barred.
- All limitations, exclusions, and disclaimers contained in this clause shall survive the termination of the User’s account, discontinuation of Services, completion of therapy, or any modification to these Terms.
Termination of Services:
You may stop using T Minds’ services at any time. While not required, we encourage you to give feedback or notify us. Any outstanding fees will be handled as per our refund policy. If you return, you may continue with the same therapist (subject to availability) or a new one.
T Minds may suspend or terminate your access at any time, with or without notice, if you violate these Terms, behave abusively or fraudulently, provide false information, or if the therapeutic relationship is no longer effective. Services may also be terminated if your needs are beyond our scope, safety cannot be ensured, or as required by law.
Upon termination, your access to the platform ends immediately. We may delete or retain your data according to our Privacy Policy and applicable laws. You cannot continue using the platform under the same or a new account if termination is due to breach or misconduct. In most cases, we will provide referrals or resources for alternative support. Refunds for unused fees will generally be provided unless termination is due to serious violations, which may be evaluated case by case.
All obligations, responsibilities, and liabilities incurred before termination remain in effect. Termination does not limit T Minds’ right to take legal action for prior breaches. For safety reasons, T Minds may immediately suspend services without notice in situations involving risk to any user or staff. Repeated failure to follow scheduling rules, including last-minute cancellations or no-shows, may also result in termination.
Intellectual Property:
- All content, materials, and information made available by T Minds Healthcare (“T Minds”)—including but not limited to the website design, text, graphics, logos, trademarks, videos, software, therapeutic resources, worksheets, session materials, and any other proprietary content (collectively, “T Minds Content”)—are the exclusive intellectual property of T Minds or its licensors. These are protected under applicable Indian copyright, trademark, and other intellectual property laws. Your use of the Services does not grant you any ownership or rights in such content.
- Except where expressly allowed, no T Minds Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, modified, reverse engineered, or used to create derivative works, in whole or in part, without our prior written permission. Limited personal use (e.g., downloading a worksheet shared during therapy for your personal self-work) is permitted, but redistribution or commercial use is strictly prohibited.
- If you voluntarily submit or post any content on our Platform (such as comments, testimonials, community posts, or contributions), you grant T Minds a worldwide, royalty-free, non-exclusive, transferable, sub licensable licence to use, reproduce, modify, publish, and display such content for the purpose of operating and improving the Services. Personal information shared during therapy remains confidential and governed by the Privacy Policy; this clause applies only to content you intentionally post or submit to public-facing parts of our Platform.
- Any third-party content used on the Platform (such as licensed psychological assessments, therapeutic tools, articles, or media) remains the property of the respective rights holders. T Minds uses such content in compliance with licensing terms and fair use provisions under the Indian Copyright Act, 1957. You agree not to infringe any third-party intellectual property rights when using our Services.
- You may not record, reproduce, publish, or distribute any therapy sessions or clinical interactions involving T Minds professionals or other clients without our prior written consent. Similarly, T Minds professionals will not disclose or publish identifiable client content without consent.
- “T Minds Healthcare” and all associated logos and marks are trademarks/service marks of T Minds. You may not use these marks in any manner that may cause confusion, imply association, or discredit T Minds without explicit written approval.
- T minds reserves the right to remove access for users who repeatedly infringe intellectual property rights and to act upon valid IP infringement notices in accordance with applicable law and safe-harbour provisions under the Information Technology Act, 2000.
- All rights not expressly granted to you under these Terms are reserved by T-Minds. Unauthorised use of T-Minds content may lead to civil or criminal liability. .
Errors, inaccuracies and omissions:
From time to time, content available on our platform or within the Services may inadvertently include typographical mistakes, inaccuracies, or omissions—such as errors relating to service descriptions, pricing, promotions, offers, availability, or other operational details. T minds reserves the absolute right to rectify, update, or amend any such information at its sole discretion, and may modify details or cancel bookings/orders if any information is found to be inaccurate, without prior notice (including after a booking has been placed).
Unless required under applicable law, we are under no obligation to continuously revise, update, or clarify information displayed on the platform, including pricing or service-related data. Any stated “last updated” or “refresh” date should not be construed as confirmation that all information on the platform or in the services has been fully revised or is current.
Disclaimer of Warranty:
- Platform Services Provided “As-Is”
T Minds’ platform and services are provided on an “as-is” and “as available” basis. You acknowledge and agree that your use of the platform is entirely at your own risk. To the fullest extent permitted by law, T Minds expressly disclaims all warranties, whether express, implied, or statutory, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title, operability, security, accuracy, reliability, or non-infringement.
While we strive to maintain high-quality services, T Minds does not guarantee that the platform or services will be uninterrupted, error-free, secure, or free from viruses, malware, or other harmful components. Occasional downtime may occur due to maintenance or unforeseen technical issues. Users are encouraged to maintain updated device security and to back up important data.
- Professional Services and Therapist Liability
All therapy, psychological wellness, or psychiatric services provided through T Minds are delivered solely by licensed mental health professionals on the platform. These professionals retain full authority, responsibility, and discretion over their services, including diagnoses, treatment, procedures, and guidance. T Minds does not guarantee any specific outcomes. All decisions or actions you take based on therapy or professional guidance are your sole responsibility. You acknowledge that any interactions or issues with therapists, wellness professionals, or psychiatrists are strictly between you and the professional. - Any activity conducted through your account (whether by you or by any other person using your account, with or without your authorization), including but not limited to negligent, fraudulent, or wrongful act

Amendments & Updates to Terms:
T minds reserve the right to modify or update these Terms and conditions at any time without any prior notice. Any modifications we make will become the part of our user agreement with you when they are posted to our site. Your continued use of services on the website or mobile application implies acceptance of changes we have made. The last date these terms and conditions were revised is set forth at the starting of this document.
Severability:
If any of the provisions of these terms and conditions is found to be invalid, void, or unenforceable by a competent jurisdiction or arbitrary tribunal under applicable Indian law such provision(s) shall to the extent permitted by law, be interpreted or modified so that it becomes enforceable while preserving its original intent. If modification is not possible, the provision(s) shall be deemed severed from these terms and conditions, and such severance shall not affect the validity, enforceability, or continuation of the remaining provisions. All other terms shall remain fully effective and binding on you and T Minds.
Waiver:
No failure, delay, or omission by T Minds to enforce any term or to exercise any right under these terms and conditions shall be construed as a waiver of such right or term. Any waiver must be expressly provided in writing by T Minds to be valid. Any consent by T minds to, or a waiver by T Minds of any breach by you, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different subsequent breach.
Governing law, dispute resolution and Jurisdiction:
Governing law: These terms and conditions are governed by and construed in accordance with the laws of India without regard to its conflict of law principles. This means even if you are an international user the agreement is under Indian jurisdiction.
Jurisdiction: any dispute arising, claim or controversy arising out of or relating to these terms or use of these services shall be subjected to the exclusive jurisdiction of the court having competent authority at Kurnool, Andhra Pradesh, India.
Dispute resolution: Both parties (you and T-Minds) agree to first attempt to resolve any dispute through informal, good-faith discussions. Before initiating any legal action, the party raising the dispute must provide written notice describing the issue and the proposed resolution. The parties will then engage in good faith negotiations for at least 30 days.
To facilitate faster and confidential resolution, the parties may mutually choose to refer the dispute to mediation or arbitration under the Arbitration and Conciliation Act, 1996. If both the parties consent in writing, a sole arbitrator will be appointed mutually. The seat and venue of arbitration shall be Kurnool. The language of arbitration shall be English. Each party shall bear its own costs. Fees of the arbitrator shall be shared equally unless directed otherwise in the arbitral award. However we will not impose arbitration unless mutually agreed.
Grievance Redressal:
In accordance with information technology act, 2000 and rules made there under, a grievance redressal forum has been setup at T-Minds to address the grievances of users. In case of any issue, dissatisfaction with any of our service, you are free to contact our grievance redressal officer Adv. Shaik husna at Kurnool, Andhra pradesh. We assure you a time bound solution not exceeding one month from the date of your complaint.
